If you are injured in a car accident, you may be entitled to compensation for a whole range of legal damages, such as past and future medical expenses, lost wages or diminished earning capacity, pain and suffering, and more. Knowing which laws and procedures apply to your particular case can be challenging, however, and the burden is on you to pursue your claim and to prove the fault of the other driver and/or the nature of your injuries and damages to the required degree of legal proof. The insurance companies, meanwhile, do their best to deny your claim or pay you fewer benefits than your claim is actually worth.
At the Law Office of J.J. Talbott, P.A. in Pensacola, we are on your side. We are knowledgeable and experienced personal injury attorneys who know how to investigate a car accident, evaluate a claim, and take the right steps to see that you get the compensation you deserve.
Florida law on car accidents involves a complicated mix of no-fault personal injury protection (PIP) insurance combined with fault-based liability and bodily injury insurance. Unless you are thoroughly familiar with all aspects of Florida car accident law and follow all the steps properly, you can be shut out of receiving all the benefits to which you are otherwise entitled. Our Pensacola attorneys know Florida auto accident law inside and out. We can evaluate your claim and advise you on the proper steps to take to secure your rights to compensation for your injuries.
While Alabama car accident law is strictly fault-based, the difficulty here lies in the state’s doctrine of pure contributory negligence. This means that claimants must work hard to fight against insurance company adjusters and their teams of defense lawyers who will devote themselves to finding ways to shift any of the fault for the accident off of their insured and onto you. If they can convince a judge or jury that you share any of the blame for the accident, then your right to recovery can be completely lost. We fight to make sure that doesn’t happen.
If you have been seriously injured in a car accident, even by an uninsured motorist, or in a hit and run, we can help you get the compensation you need to recover from your injuries and move forward with your life. Our practice extends across the Florida panhandle and southern Alabama. If you or a loved one has been injured due to the negligence, carelessness, recklessness, or distracted driving of another, call the Law Office of J.J. Talbott, P.A. in Pensacola for a free case review.
Pharmaceutical companies and medical device manufacturers will continue to be held liable for injuries related to hundreds of Drugs and Medical Devices for failing to warn of dangerous side effects associated with their products. You may be eligible for compensation if you’ve suffered because of a drug or device manufacturer’s negligence. Call us on (850) 695-4850 immediately if you believe that you or a loved one may have a claim, time is often a very strict factor.
As Florida’s leading deep-water port, Pensacola sees a tremendous amount of commercial trucking traffic moving through the city as tractor-trailers travel back and forth along the 110 and I-10, linking Pensacola with the nation’s interstate highway system. With this heavy traffic comes the increased likelihood of serious truck accidents and catastrophic injuries. In Florida and Alabama, truck crashes are responsible for hundreds of deaths and thousands of serious injuries every year. At the Law Office of J.J. Talbott, P.A., our personal injury and wrongful death attorneys know what it takes to recover significant compensation from the truckers, trucking companies, and their insurers when negligence or recklessness in the trucking industry causes serious harm.
A fully loaded tractor-trailer may weigh 40 tons, and even a semi-truck alone can weigh 15 tons without any cargo. When one of these big rigs strikes a car while traveling at highway speeds, the results can be disastrous for the occupants of the smaller, lighter vehicle, who risk serious personal injury or wrongful death. In addition to the force imparted by a loaded semi, the size and weight of the truck affect the stopping distance, reaction time, and handling of the driver. Also, the size and shape of the truck create blind spots for the trucker on all four sides of the truck for several car lengths and across several lanes of traffic. Smaller vehicles in the vicinity have difficulty seeing around the truck and having a good understanding of traffic and road conditions ahead. For all these reasons and more, care must be taken by truck drivers and motorists to avoid a serious collision.
Semi-trucks must be regularly inspected and maintained between each trip and even mid-trip to make sure they can be driven safely.
Trucking accidents are often attributed to truck failures such as:
Truckers and trucking companies have a duty to keep these trucks maintained and in a safe condition.
The majority of truck accidents are attributed to driver error. Truckers are paid by the miles they drive and are rewarded based on how quickly they can deliver their goods to their destination. Despite federal regulations that limit how long truckers may be behind the wheel, many drivers ignore the regulations and drive beyond what is safe. Truck accidents are often caused by factors such as:
At the Law Office of J.J. Talbott, P.A., we understand how to properly investigate a trucking accident, such as by reviewing the driver’s log and vehicle inspection and maintenance logs to determine whether the driver and trucking company were in compliance with federal safety regulations. We also know that these logs are sometimes falsified and look for ways to hold truckers and trucking companies accountable for their negligence or misconduct. If you or a loved one has been seriously injured in a truck accident in southern Alabama or along the Florida panhandle, contact our office for a free case review and assistance in getting the maximum amount of compensation available.
Defective products are responsible for hundreds of thousands of injuries every year. From defective car parts to dangerous drugs to baby blankets, product defects are present in every aspect of our lives. Product makers owe a duty to only place safe products on the market, yet time and again manufacturers place their duty to their shareholders to make a profit ahead of their duty to public safety. When this occurs, the lawyers at the Law Office of J.J. Talbott, P.A. in Pensacola come to the aid of injury victims in all forms. We stand up for the rights of the consumer and are not afraid to take on the automotive and pharmaceutical giants of big industry. In Florida and Alabama, contact us when you or a loved one are harmed by a defective product.
There are many different legal theories that can be explored to hold manufacturers liable for defective products, including breach of an express warranty, breach of an implied warranty, and negligence. Under one theory of liability, known as strict products liability, product makers are liable whenever a defective product causes harm to a consumer. If the product left the manufacturer’s control in a defective condition, it is not necessary to prove negligence or fault on the part of the manufacturer, just that the product was defective and caused an injury.
There are three main ways products may be considered defective: design defects, manufacturing defects, and failure to warn defects.
Design Defects – When a product is defectively designed, every single unit manufactured carries the defect, leading to the potential for thousands or millions of injuries unless the product is recalled and the problem fixed. Examples of design defects may be cars that explode on impact or rollover and cave-in at the roof, power saws without safety guides, or household appliances like irons built without automatic power shut-offs. Sometimes a simple safety feature would cost only pennies per unit, but manufacturers choose to save the money and fight injury lawsuits as they arise.
Manufacturing Defects – When a product is defectively manufactured, the defect may occur in only one unit, or it may occur in thousands of units until the problem is found. This can happen when the error occurs because of an incompetent worker or faulty machinery on the assembly line, or when substandard materials are used.
Failure to Warn – Products that can pose a danger must include clear warnings about the danger and instructions for their safe use. This includes household chemicals or industrial solvents that should be used in a well-ventilated area with gloves or goggles on, or products that should not be mixed with others, like certain cleaning supplies or medications. When product warnings are not clear and conspicuous, the product may be considered defective, with the manufacturer liable for injuries that result.
Regardless of the type of product, the type of defect, or the type of injury, the attorneys at the Law Office of J.J. Talbott, P.A. can help you recover the compensation you need and deserve when you are injured by a defective product. In Florida and southern Alabama, contact us for a free case review to find out how we can help.
Victims of motorcycle accidents may suffer serious, debilitating injuries or worse. In fact, it may come as no surprise to hear that, motorcycle riders are much more likely to die in a traffic accident than an occupant of a passenger vehicle. Many different factors may lead to motorcycle accidents, but often they are caused by the negligence of an aggressive, reckless, or distracted driver. At the Law Office of J.J. Talbott, P.A. in Pensacola, our injury attorneys help people who have been seriously hurt in motorcycle accidents across the Florida panhandle and in southern Alabama. We fight to get you the compensation you deserve.
Many factors come together to make traffic and highway motorcycle accidents particularly dangerous. Of course, riders are exposed and vulnerable to an impact with another vehicle, the roadway, or a stationary object, with little to protect them besides the bike they are on and perhaps a helmet and some leathers. But there are other factors as well. Bikers may have limited visibility to see what is happening with traffic around them and up ahead, and they are harder to be seen by drivers of cars, trucks, and SUVs. The maneuverability of a bike means they often travel faster than the traffic around them and make lane changes more frequently, but at the same time, there are limits to their safe handling and stability which other drivers may not understand.
A major concern for motorcycle riders is the attention (or lack) paid to them by other drivers on the road. Distracted drivers may not see a motorcycle until it is too late to avoid a collision, or they may make sudden stops or turns that cause a crash. Some drivers simply do not respect the fact that they have to share the road with motorcycles, and they drive recklessly or aggressively around the bike.
Many people who do not ride motorcycles have a bias against them and tend to think that motorcyclists ride aggressively or recklessly. This attitude can be disastrous to you in a case involving motorcycle accidents. Alabama’s laws of contributory negligence can bar you from recovery, and even in Florida, your chance at obtaining full compensation for your injuries can be significantly reduced if you are blamed for any of the fault in the accident. Following these common-sense tips can help ensure that your own riding is not subject to blame for any accident that may happen:
If you are a motorcyclist, practicing safe riding tips such as the ones above may decrease your chances of being injured in a collision with a motor vehicle. Unfortunately, no matter how careful you ride, you may still become the victim of a crash due to the negligence or recklessness of another driver. When that happens, you need representation from aggressive and effective personal injury lawyers who will go up against the insurance companies and fight for you in court to help you get the compensation you need and deserve. In Florida and Alabama, count on the Law Office of J.J. Talbott, P.A. to provide you with the representation you need. Call today at (850) 695-4850.
When a death occurs because of another person’s negligence or wrongful conduct, the surviving family members suddenly find themselves faced with immediate expenses and a future of financial uncertainty, coupled with the pain, frustration, anger, and other emotions that come from losing a loved one in a needless, preventable tragedy. The attorneys at the Law Office of J.J. Talbott, P.A. in Pensacola understand the difficulties that spouses and children face when they lose a spouse or parent. Our lawyers also understand what it takes to recover the compensation they need to move forward. We help families in Florida and Alabama recover appropriate compensation under their state’s wrongful death laws.
Florida wrongful death law authorizes the personal representative of the deceased to pursue an action against the wrongdoer for the benefit of the surviving spouse and children. Other family members may also recover compensation if they were dependent on the deceased for services and support.
Damages that can be recovered against the party responsible for causing the death include:
These cases can be difficult to prove, especially when the deceased was not able to give an account of the events that transpired before passing. Nevertheless, our attorneys have the resources and experience needed to investigate the cause of a car wreck or truck accident and determine who should be held liable. Despite the difficulties the case may present, our lawyers fight hard to see that justice is done and that our clients are compensated appropriately.
Alabama wrongful death law is different from Florida law or other states in the nation. Rather than compensating the surviving family members for their loss, wrongful death damages in Alabama are punitive in nature, meant to punish the wrongdoer for causing the death of another through negligence or misconduct. These cases must be approached differently from personal injury claims; it takes a measure of knowledge, skill, and dedication to develop a persuasive case for damages in an Alabama wrongful death lawsuit.
At the Law Office of J.J. Talbott, P.A., we represent victims and families in personal injury and wrongful death actions in Pensacola, Fort Walton Beach, and throughout the Florida panhandle and southern Alabama. If you lost a loved one due to the negligence or wrongful conduct of another, call our office at (850) 695-4850 to speak with an attorney about holding the responsible party accountable for their actions and making sure you are not burdened with financial losses.
A slip and fall can cause serious personal injury, especially to older persons who may be prone to fractures from a fall. A broken wrist, hip, or ankle can be very painful and debilitating and take a long time to heal or create permanent disability. Other dangers of a trip and fall or slip and fall include head, neck, and back injuries which can be serious or cause permanent damage, from muscle tears and facial disfigurement to concussions and brain damage. At the Law Office of J.J. Talbott, P.A. in Pensacola, we fight to hold property owners responsible when their negligence is the cause of a painful slip and fall injury.
Our premises liability attorneys represent accident victims harmed in all of the following situations:
In Florida, property owners have a duty to maintain their premises in a reasonably safe condition and to warn against any known dangers for the safety of persons invited on to the property, such as customers or guests, as well as people on the property for a business purpose, such as delivering mail or packages. Even trespassers may be able to recover compensation if they are injured by the willful or wanton conduct of the property owner.
Often a slip and fall or trip and fall is caused by what Florida law calls a “transitory foreign substance,” such as a food or drink spill in a grocery store or restaurant, or a box or product on the floor of a department store. Property owners are liable for these conditions when they either knew or should have known about the hazard and failed to clean it up in a reasonable period of time. Proving that the owner had actual or constructive notice of the condition is often one of the most difficult and complicated aspects of personal injury law. Industry experts are sometimes needed to help determine how long a condition existed before the accident and whether the owner was unreasonable in not correcting the condition in time.
Alabama has its own strict laws which must be followed before a property owner can be held liable for a slip and fall. First of all, the accident victim must be legally on the property at the time, i.e. not a trespasser. Also, as in Florida, the property owner must have had actual or constructive notice of the hazard yet failed to fix it or warn of the danger. Finally, under Alabama’s strict rule of pure contributory negligence, any fault on the part of the injured party could act to prevent any recovery at all.
At the Law Office of J.J. Talbott, P.A., our attorneys have the knowledge, skills, and experience to know how to properly investigate, evaluate and pursue a slip and fall claim to achieve justice and appropriate compensation for the accident victim. If you have been injured in a trip, slip or fall on another’s dangerous property, contact the Law Office of J.J. Talbott, P.A. for a free case review. We serve clients in Pensacola, Fort Walton Beach, and across the Florida panhandle and southern Alabama.
Our job as personal injury attorneys is to stand up for the rights of people who have been injured by the neglect or misconduct of others and who need a strong, effective voice to speak on their behalf. This role is most relevant than when representing our most vulnerable seniors who have been abused or neglected in a hospital, nursing home, or assisted living facility. Our lawyers represent nursing home residents and their families throughout Florida and Alabama, helping them obtain compensation for the harm done to them while holding nursing homeowners and staff accountable for their negligent or abusive behavior.
The elderly population in America is growing rapidly and will continue to do so for decades. As a greater portion of our population ages, and as we continue to live longer lives, the need for long-term care, assisted living, and skilled nursing care facilities will continue to rise. A major concern is whether enough facilities can be adequately staffed with plenty of qualified, trained, and properly supervised caregivers to deliver the quality of attention and care our seniors need. Unfortunately, nursing home neglect and abuse are on the rise throughout the country. As a popular retirement destination for millions of Americans, Florida, in particular, must address this pressing issue.
Pensacola is fortunate to have several high-quality nursing facilities for the elderly and disabled, as measured by Medicaid on their Nursing Home Compare website. However, we also have our share of average, below average, and much below average facilities, according to the same standards. Regardless of where you or a loved one resides, it is important to remain vigilant for signs of abuse or neglect and to speak up whenever you believe you or a family member are being harmed.
Our lawyers help victims of abuse and neglect who have suffered any of the following injuries, among others:
Nursing home residents have rights and may be able to complain of abuse or neglect to various state agencies. However, the wheels of government turn slowly, and if you or a loved one is suffering at the hands of another, you need that mistreatment to end immediately. For suspected abuse or neglect in the Florida panhandle or southern Alabama, call the Law Office of J.J. Talbott, P.A. for help right away. We will move immediately to make sure you or your family member is properly taken care of, and we will take steps to obtain justice and any compensation which may be due for any harm suffered. Call (850) 695-4850 to have one of our attorneys contact you.
